Colorado Nursing Facility Culture Change

House Bill 12-1294 – New Change of Ownership (CHOW) Provisions

FYI. The Department reviews changes of ownership and charges a fee for such review.  House Bill 1294 changed the definition of change of ownership (CHOW).  The description below shows the differences before and after. Before  the passage of HB 1294, the definition of a change of ownership (CHOW) differed according to the type of ownership structure.  The following were considered CHOWs: for partnerships:  dissolution of the partnership or substitution of a partner for sole proprietors:   transfer of the title to the business, but if the individual decided to form a corporation with the owner as the single shareholder, it was not a CHOW. for corporations:   any transaction that involved a change in at least 75 percent of the ownership   for a limited liability company (LLC):   a transfer of 50 percent or more of the ownership or dissolution and conversion to another entity type accompanied by a change in principals. House Bill 12-1294 – New “Fitness Review” Provisions

FYI. The Department conducts a “fitness review” to determine whether owners of licensed health facilities have any criminal convictions or civil actions that would prevent them from operating in the state of Colorado. House Bill 1294 changes when and how a fitness review is conducted. The information below shows the differences before and after. Before the passage of HB 1294, fitness review was conducted for new and existing owners with a look-back period of ten years. So, the Department reviewed records of activity that occurred within the ten years preceding the date of the application. After the passage of HB 1294, fitness review is limited to new owners (i.e., applicants applying for a new health facility license). Existing owners are reviewed only when the Department has new information that was not previously available or disclosed in the prior fitness review. Piloting Joint Oversight of Facilities Serving Persons with Developmental Disabilites

The Colorado Department of Public Health and Environment and the Colorado Department of Human Services has embarked on a one year pilot project between its Health Facilities and Program Quality Survey Units. This pilot aims to reduce administrative redundancy and improve the quality of services delivered to individuals enrolled in services by focusing on efficient methods of regulatory oversight while emphasizing practices that improve the quality of life of people receiving services. This pilot program fulfills the requirements and sprit of House Bill 12-1294 by creating an environment in which the two departments can work together more efficiently and effectively for the benefit of people in service and providers alike. On-site Compliance Assistance for Pharmaceutical Waste Disposal

On March 6, 2013, the Hazardous Materials and Waste Management Division (HMWMD) of CDPHE mailed out packets of information to the administrator of every licensed LTCF in Colorado regarding the proper disposal of pharmaceutical waste. CDPHE's goal is for all LTCFs in Colorado to be in compliance with solid and hazardous waste regulations regarding pharmaceutical waste disposal by September 1, 2013. To help reach that goal, the HMWMD is offering free on-site compliance assistance to LTCFs that request a site visit. The site visit usually takes 2 to 2 and 1/2 hours and any violations found during that time are immune from escalating enforcement or penalties as long as the deficiencies do not present an imminent threat (very unlikely) and are corrected by the agreed-upon time frames. Pueblo MDS Training

To: NHAs, DONs, MDS Coordinators, IDT Members MDS 3.0 training will be held in Pueblo on April 16th and 17th at the La Quinta Inn on North Elizabeth. We will again review the MDS 3.0 with emphasis on the Resident, and also delve deeper into the intricacies of the tool. We will also be talking more in-depth about quality measures, evacuations and Care Plans along with any new directives from CMS. Training will be provided to the MDS coordinators all day Tuesday and Wednesday. Training for the IDT members will be included in the Tuesday training. This change in format should allow us more time to discuss the finite points and to answer questions. The room will be open 7:30AM to 4:30PM both days. NHAs and DONs are welcome at any time.
